I, (the undersigned), understand that participation in Healthy Harbor events is entirely voluntary. I understand that the field programs may involve but not be limited to the following: boating and other outdoor activities, including using tools, digging, kneeling, lifting, and bending. I know and understand the risks and danger involved in the activities, and I know and understand that unanticipated danger might arise.
I hereby release Waterfront Partnership of Baltimore, the Mayor and City Council of the City of Baltimore, and the respective affiliates, agents, sub-contractors, vendors, and employees of each (collectively “WPB”) from any responsibility for injury which might occur as a result of participation in these activities. Furthermore, I hereby fully and forever release, waive, and discharge WPB from any and all claims, demands, suits, and actions whatsoever of every nature and description, arising as a result of any direct or indirect, known or unknown, absolute or contingent, in both law and equity, which I have or may have, arising out of or relating to my participation, including specifically all claims for personal injury, paralysis, wrongful death, property damage and any other injury I may sustain.
I know of no reason, medical or otherwise, that would prevent me from performing the tasks required to participate in the Healthy Harbor events. I will be personally responsible for my own safety during these activities and assume all risks and accept full and complete responsibility for any and all damages and personal injury of any kind.
I also give permission to authorized personnel to carry out emergency diagnostic and therapeutic procedures as may be necessary for me and also permit such treatment procedures to be carried out at and by a local hospital in the event of an emergency. I understand that any medical expenses will be billed directly to me or my insurance company.
Audio-visual Production Waiver
In order to promote our educational and volunteer programs, Waterfront Partnership sometimes use participants’ names, voices, and/or photographs in connection with media resources but not as an endorsement. I hereby give permission for WPB to use my name, voice, and/or photograph in connection with audio-visual productions, voice, photographs, and/or online websites, social media, and similar outlets.
COVID-19 Disclaimer
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. Waterfront Partnership of Baltimore (“WPB”) in no way warrants that COVID-19 infection will not occur through engaging in WPB events and activities.
Waiver of Liability Relating to Coronavirus/COVID-19
ASSUMPTION OF RISK: I, (the undersigned), have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID- 19 for myself and/or my minor child(ren) or those minor child(ren) I am a legal guardian of (identified below and collectively referred to as the “Minor”) as a result of participating in the activities of WPB and understand that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 as a result of participating in WPB activities may result from the actions, omissions, or negligence of myself and others, including, but not limited to, WPB, WPB vendors, WPB employees, WPB agents, and other participants. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my participation in WPB activities (“Claims”).
I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS AND THE MINOR’S RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE:
